Overview

The first edition of this work, an explanation and critique of the provisions on the protection of industrial designs contained in the Copyright Designs and Patents Act 1988, appeared in 1989. This second edition has been prompted by the appearance of European Commission proposals for the protection of designs, and the sometimes controversial case law, since 1989, on the British legislation. The technical discussion is set against a background of the general considerations currently affecting intellectual property law, in particular its relationship with competition law.
