Overview
EU public procurement rules were introduced to ensure fair and open competition by and between EU member-states for contracts of goods, services and construction projects. These rules affect tenders not only for central governments and local authorities, but also for public utilities, quasi-public bodies (eg, NHS trusts), and the transportation and telecommunications industries.Although the Procurement Directives have existed for a number of years, the law on the subject is complicated and not well understood, and severe penalities are made if the rules are breached. Already there have been cases of unsuccessful tenderers recovering damages through the courts.
