General & Miscellaneous Law, Law, Philosophy of, Legal Theory & Philosophy - General & Miscellaneous, Interpretation & Construction of Law, Legal Methodology & Language
This book is a translation of Reinhold Zippelius' Juristische Methodenlehre, (Munich, C.H. Beck, tenth edition, 2006). The approach of the original German-language volume is to engage civil law students in the processes by which one learns the law and reasons in the law β thus, the title of Zippelius' work in English could easily be "Thinking Like a German Lawyer." This volume was chosen because of its wide influence in Germany and the fact that it provides not only intellectual insight in comparative legal systems, but also equips the practitioner to understand how the civil lawyer sitting across the table understands law β the insider comparativism that is the basis for the entire series.
Synopsis
"The German original of this influential treatise on the basic methods of legal science introduces the student to the methods of finding, interpreting, and applying the law, as well as to the basic ideas and principles related to the concept, function, and purpose of the law. This translation's unique value lies in the fact that it is not a gloss, not secondary literature, not an interpretation, and not a summary - it is a direct, primary source that makes the perspective of the German student of law on the ideas that have shaped legal practice, both in Germany and on the continent of Europe, available to an English-speaking audience for the first time."--BOOK JACKET.
