About the Multistate Performance Test (MPT)

The MPT is a written exam used in determining competence to practice. It is intended to mimic real-life legal tasks that future lawyers may face.

The MPT is administered  in 33 jurisdictions of the United States.

It consists of two 90-minute sections with questions covering:

  • legal analysis
  • fact analysis
  • problem solving
  • resolution of ethical dilemmas
  • organization and management of a lawyering task
  • communication

The MPT is administered on the Tuesday before the last Wednesday in February and July of each year.

How does the MPT differ from the Multistate Essay Exam (MEE)?

  • On the MPT, test takers write like a lawyer, outlining the key issues and making recommendations to your client. On the Essay Exam, they write like a law student, using IRAC and exploring various possible conclusions and/or courses of action.
  • On the MPT, they limit the answer to the specific question asked. On the Essay Exam, they “issue spot” and address all of the issues.
  • On the MPT, they are given many sources from which to draw. On the Essay Exam, they are given a single fact pattern.
  • On the MPT, prior knowledge of an issue can be detrimental. The examiners provide a case, but occasionally alter it to make it fit the facts in the question. On the Essay Exam, knowledge of an issue—whether gleaned from bar review or law school courses or the evening news—will help in answering the questions.
