Synopsis
Thoms (law, U. of South Carolina) reworks and updates the work of the late Phillips (law, U. of Tennessee) for this new "In a Nutshell" volume providing succinct explanation of products liability law in the US. Section one, on theories of liability, contains chapters on negligence, tortuous misrepresentation, warranty, and strict liability in tort. The next section deals with product defectiveness and contains discussions of the nature and proof of defectiveness, manufacturing defects, design defects, and limitations on defectiveness. Examination of causation follows, and includes chapters dealing with cause in fact and proximate cause. User misconduct and other defenses are explored, as are special issues such as special types of defendants, special types of transactions and products, automotive litigation, and punitive damages.
